DHS involvement, temp custody and adoption of relative
Hello,
I live in Arkansas. I am trying to adopt my great-niece who lives in Ohio. DHS has temp custody now and my g-n is in foster care. I was told I could not be considered as temp placement as I lived out of state, I have since found out this is untrue, but that is not why I am posting.
Both parents know they will not win in court and wish to keep this child in our family, they are willing to allow me to adopt and ready to sign whatever forms are needed. I am not sure if I am being told the truth by DHS as to what rights they may or may not have at this time. There is a hearing set for in Jan where the state will take perm custody of my g-n. She is 9 months olds. DHS keeps telling me that she has already bonded to the foster family and it would not be in her best interest to be placed with me, as it would cause great trauma. The foster family is also trying to adopt my g-n btw.
Does anyone have information regarding bonding at that age? I want to keep our family together.
Any help? PLEASE.

I would suggest contacting an adoption attorney to learn more about your rights. There is a strong move toward keeping children with family, and an attorney may be able to give you guidance.

You would not be legally required to have an open adoption or contact with her mom after the adoption is finalized. However, since she obviously knows her mom, it can be really hard on a child to...
