Forms from the USCIS (U.S. Citizenship & Immigration Service)

Notes:

Generally, adopting parents file USCIS Form I-600A (Application for Advance Processing of Orphan Petition) beforethey identify a foreign-born child to adopt. This allows the USCIS to first process the application that relates totheir ability to provide a proper home environment andtheir suitability as a parent. Then, once a child who meets the INA's definition of orphan is identified,they must file USCIS Form I-600 (Petition to Classify Orphan as an Immediate Relative) in behalf of the child. The full process is covered in booklet M-249: Immigration of Adopted and Prospective Adopted Children.

USCIS Form I-600A: Application for Advance Processing of Orphan Petition

  • To speed part of the processing for an orphan petition relating to the petitioner before an orphan (who will be adopted by the U.S. citizen filing the application) is located.
  • Filing fee: $525 (no additional fee for the I-600)
  • Filed at your local USCIS office

USCIS Form I-600: Petition to Classify Orphan as Immediate Relative

  • To classify an alien orphan who either is, or will be, adopted by a U.S. citizen as an immediate relative of the U.S. citizen to allow the child to enter the U.S. The petition is filed by the U.S. citizen who is adopting the child.
  • Filing fee: $525 if I-600A was not filed; otherwise no fee
  • Where to file: Atyour local USCIS office

USCIS Form I-824: Application on an Approved Application or Petition

  • This form will be used to request a duplicate approval notice, to request approval notice to another U.S. Consulate; and to request notice to a U.S. Consulate for derivative visas to family members.
  • Filing fee: $195
  • Where to file: The USCIS office that approved the initial application

USCIS Form I-864: Affidavit of Support

  • To show that an intending immigrant has adequate means of financial support and is not likely to become a public charge.
  • Filing fee: None
  • Where to file: Either a Consular Officer with Form OF-230, Application for Immigrant Visa and Alien Registration, or an Immigration Officer with Form I-485, Application to Register Permanent Residence or Adjust Status.

USCIS Form N-600: Application for Certificate of Citizenship

  • For an individual to document U.S. citizenship status based on citizen parentage.
  • Filing fee: $200 when filed by a U.S. citizenon behalf of a minor child
  • Where to file: Submit to the USCIS office with jurisdiction over your place of residence. (Note: This form is not required for children who enter the U.S. on a IR-3 visa (the adoption was completed abroad). They will automatically be sent a certificate of citizenship within 45 days of entering the U.S.)

USCIS Form N-600K: Application for Citizenship and Issuance of Certificate under Section 322

  • For a child who regularly resides abroad to claim U.S. citizenship based on parentage.
  • Filing fee: $200 when filed by a U.S. citizen on behalf of a minor child
  • Where to file: Any USCIS office

Form W7: Application for IRS Individual Taxpayer Identification Number(ITIN)

  • If your child enters the U.S. on an IR-4 visa (the adoption was not completed abroad)and is not yet a U.S. citizenby the timeyou file taxes, apply for the ITIN for your child.
